Linxus Website Terms and Conditions

As per Section 11(3) of the Electronic Communications and Transactions (ECT) Act, these terms and conditions are binding and enforceable for all who access any part of the Linxus Web site. Should you not agree to these terms and conditions, please note that further use of the Linxus Web site will automatically bind you to these terms and conditions.

1. Allowed use and License

  1. Users are allowed to view, print and download all content displayed on the Linxus Web site. However, this is on the proviso that this content is referenced to Linxus and used for personal and non-commercial purposes
  2. Content from the Linxus Web site should not be used for commercial purposes without the written consent from Linxus
  3. Users may only access Linxus’s Web site to conduct legal operations
  4. If the content on Linxus’s Web site is wrongfully utilised, Linxus:
    1. Reserves the right to claim damages from the user
    2. Reserves the right to lay a criminal charge against the user
    3. Shall not be liable for any damage, loss or liability resulting from the use of content obtained in breach of these terms and conditions
  5. All hyperlinks to the Linxus Web site should be directed to the home page. Anyone linking to a page other than the home page does so at their own risk
  6. No-one – with the exception of recognised search engine operators – may search or copy content from the Linxus Web site without the consent of Linxus

2. Intellectual property rights and domain name use

  1. All intellectual property displayed on the Linxus Web site is the property of Linxus and therefore protected by local and international legislation.

  4. Remove any area or function of the Linxus Web site
  5. Modify or change the minimum system requirements for accessing the Linxus Web site

5. Privacy

  1. Linxus will take all reasonable precautions to protect the personal information of users. Personal information is defined as per the Promotion of Access to Information Act 2 of 2000
  2. Linxus may collect, save, compile, share, disclose or sell any information collected from users, except under the following conditions:
    1. Linxus will not disclose personal information about the user, without their prior consent
    2. Linxus will only disclose personal information after following due legal processes
  3. Linxus may compile, use and share any and all information that does not relate to a specific individual
  4. Linxus owns and retains all rights to non-personal statistics collected form the Web site

6. Hyperlinks to third party sites

  1. Linxus may provide hyperlinks to external sites. These do not serve as endorsements and Linxus accepts no responsibility for the content illustrated on such sites

7. Security

  1. Linxus shall take all reasonable precautions to protect the data on its Web site, as well as all information provided by and accessible to users. However, Linxus does not guarantee that any information is one hundred percent secure
  2. Linxus is not under legal duress to encrypt content sent to or from the Linxus Web site. Similarly, Linxus is not bound to provide digital authentication of any page on its Web site
  3. Under no circumstances may users deliver or try to deliver any malicious or damaging code to the Linxus Web site, server or network
    1. Any person that does deliver such code to Linxus shall be prosecuted
    2. Linxus reserves the right to claim damages from any personal responsible for a security breach of Linxus’s network, server or Web site
  4. No user may develop or use a device designed to overcome the security measures implemented by Linxus

8. Disclaimer and limitation of liability

  1. Linxus shall not accept liability for any damage, loss or liability resulting from:
    1. Access to the Linxus Web site
    2. Access to hyperlinks contained on the Linxus Web site
    3. An inability to access the Linxus Web site
    4. An inability to access hyperlinks contained on the Linxus Web site
    5. Content contained on the Linxus Web site
    6. The download of content available on the Linxus Web site
  2. Information, ideas and opinions contained on the Linxus Website are not necessarily those of Linxus and should not be considered as such
  3. Linxus does not guarantee that the content contained on its Web site will in all cases be true or free of any errors. While every effort will be made to ensure that content is true, users are encouraged to report any inaccuracies to Linxus

9. Removal and correction of content

  1. Linxus undertakes to correct or remove all incorrect, defamatory, harmful and illegal content from its Web site. Again, users are encouraged to report any such material to Linxus

10. Agreement in terms of Section 21 of the ECT Act

  1. The user and Linxus agree that:
    1. Both are bound to the terms and conditions presented in this document. This agreement is concluded in Johannesburg, South Africa; at the time that the user enters the Linxus Web site
    2. Data messages sent to Linxus are deemed received only when responded to

11. Applicable and governing law

  1. The Linxus Web site is hosted, controlled and operated from South Africa and is therefore governed by South African law
